These Privacy Policy, are a set of provisions governing the online sale, order, purchase and payment of Our products (Ann's Bakehouse & Creamery or PT Berawal Dari Kue) on Our official website https://www.annsbakehouse.com/ , as well as the provision of products ordered and purchased online through Our official website.

For clarity of the words used in this Privacy Policy, the following capitalized words have the following meanings:

 1. “You” or “Your” or “Yours” is the party who places an order and/or makes a purchase of Our products on Our official Website.

2. "We" or “Our” or “Us” or “Ours” is PT Berawal Dari Kue or known by the trademark Ann's Bakehouse & Creamery. 

3. “Website” is Our official website with the URL: https://www.annsbakehouse.com/ which is also Our official online sales channel that serves online orders and purchases. 

4. “Personal Data” is any data that identifies or can be used to identify, contact or track an individual, alone or in combination with other information, directly or indirectly.

  1. Voluntary collection from You, such as, among others, when placing an order or making a purchase through the Website or at the time of registration (sign-up) on Our Website, or when You submit Your Personal Data through Our Customer Service and Our Offline Stores.

You hereby represent and warrant that the submission of Personal Data belonging to the recipient You specify has been agreed/consented/approved by the data subject of the Personal Data or the recipient You specify. You hereby promise to indemnify and defend Us from any charges, lawsuits, claims, and compensation from the data subject or recipient, if the data subject or recipient whose Personal Data You submitted to Us turns out to not agree to the submission of his/her Personal Data to Us.


5. Disclosure to Expedition Services:

  1. If You choose to use Expedition Service to deliver the product, then We must disclose and submit Personal Data that You submit to Us to the party of the Expedition Service, such as, among others, the full name and telephone number of You or the recipient, and Your or the recipient’s delivery address.
  2. By choosing the delivery option using Expedition Service, it means that You give Your consent to Us to disclose and submit the Personal Data that You submit to Us to the Expedition Service, for and on behalf of Yourself or the recipient whose Personal Data You submit to Us.


6. Responsibilities:

  1. You are solely responsible for maintaining the security and confidentiality of Your Personal Data that You store Yourself (under Your control and/or supervision), that You submit to third parties, and that are collected by third parties.
  2. We cannot be held responsible in any form for all consequences arising from Your negligence in maintaining the security and confidentiality of Your Personal Data, consequences arising from breaches of security and confidentiality of Personal Data collected and/or stored by third parties, and consequences arising from breach of security and confidentiality of Personal Data that is not caused directly by our negligence or mistake.

7. Right to Access:

  1. You have the right to ask Us to provide Your Personal Data that We store. When You ask Us to provide Your Personal Data, We will conduct a verification towards You to ensure that You are the data subject authorized to request the provision of Personal Data.

If You submit Personal Data belonging to a third party to Us, such as, among others, the recipient You specify to receive product orders, and You submit a request to Us to provide Personal Data belonging to that third party, then the request will only be processed by Us, if the data subject concerned agrees/consents/approves, which approval must be proven to Us in writing.
  3. We will verify the data subject requesting the provision of the Personal Data that We store to ensure that the data subject is the data subject authorized to request the provision of the Personal Data.


8. Retaining of Personal Data:

  1. We will only retain Personal Data as long as:
  2. We still need it for the purposes mentioned in this Chapter;
  3. The retention is still relevant to Us;
  4. The retention is not prohibited by the applicable laws and regulations or the competent authority; and/or

9. Deletion and Destruction:

  1. You have the right to ask Us to delete and destroy Your personal data that We store.
  2. If You submit Personal Data belonging to a third party to Us, such as, among others, the recipient You specify to receive product orders, and You submit a request to Us to delete and destroy the Personal Data belonging to that third party, then the request will only be processed by Us, if the data subject in question agrees/approves/consents, which approval must be proven to Us in writing.
  3. We will verify the data subject requesting the deletion and destruction of his/her Personal Data that We store to ensure that the data subject is the data subject authorized to request the deletion and destruction.
  4. Please note that, in the event that You or Your designated recipient requests deletion and destruction, there is a possibility that We may not be able to process orders and purchases that You make, considering that the processing of orders and purchases requires Personal Data to be carried out, such as, among others, full name, telephone number, and delivery address.


10. Corrections and Changes: Data subjects whose Personal Data We store have the right to ask Us to make corrections or changes to their Personal Data that We store. We will verify the data subject who requests the correction or change to his/her Personal Data that We store to ensure that the data subject is the data subject who is authorized to request the correction or change.

  1. You are solely responsible for maintaining the security and confidentiality of the following sensitive information:

​a. Username ("User Id") and password that You create at the time of registration (sign-up) on Our website which is intended to access customer account on the Website;

​b. Data related to the payment instrument You use in payment, such as, among others, credit card number, credit card expiration date, one-time password for payment authorization, payment instrument security code, and payment instrument password; and

​c. Proofs of order and payment for the product,

​d. Hereinafter collectively will be referred to as “Sensitive Information”.


2. Sensitive Information:

​a. Sensitive Information in the form of User Id and password is confidential information that You use to access Your customer account on Our website and make orders and purchases on Our website.

​b. Sensitive Information in the form of User Id should only be known by Yourself and not disclosed to any party to prevent unauthorized account takeover ("Account Takeover"). Meanwhile, Sensitive Information in the form of a password, as You change it from time to time, may only be known by You and kept confidential from any party. Any access to Your customer account by logging in using the correct User Id and password will be considered as valid access to Your account, regardless of who is logging in. Therefore, We strongly urge You to maintain the confidentiality of Sensitive Information in the form of User Id and password to avoid Account Takeover risk.

​c. Sensitive Information in the form of data related to payment instruments must be kept confidential from any party to prevent the risk of payment hacking.

​d. Please remember that Our Employees have never and will never ask You to disclose Sensitive Information in the form of passwords and data related to payment instruments that only the owner/holder of the payment instrument should know.


3. Security and confidentiality of Sensitive Information can be maintained by applying the precautionary principle by means, including but not limited to:

​a. Avoid and do not use programs that can endanger the security of You and/or Us in accessing the Website and/or Your account, such as, among others, viruses, trojan horses, worms, spyware, malware, or any program that is destructive or potentially give negative impact on the security of Our Website and Your account;

​b. Not accessing Your account or logging in on a device that contains the program as mentioned in letter a above.

​c. Not accessing Your account or logging in on a device that You do not own or have full control over.

​d. Not disclosing Your Sensitive Information to any party, especially those who are not authorized to know it.

​e. Avoid using public wifi networks in logging in, placing orders and making purchases on the Website, or making online payments.


4. We cannot be held responsible in any way for all consequences arising from Your negligence or error in maintaining the security and confidentiality of Sensitive Information or from Your negligence or mistake in applying the precautionary principle as referred to in this Chapter.

  1. “Intellectual Property” means all intellectual property including but not limited to: trademarks, internet domain names, URLs, identification symbols, licenses, patents, applications, trade secrets, copyrights, technologies, software, source code, related algorithms, models and methodologies, technical specifications, designs, concepts, and other intellectual property, whether registered or unregistered under any laws, located or recognized as intellectual property in Indonesia or in other jurisdictions.
  2. All Intellectual Property contained in Our Website and Our products are entirely Our property. Orders and purchases of products that You make cannot be considered as a transfer of Our intellectual property rights to You.
  3. Without Our written consent, You are not allowed to reproduce, duplicate, disseminate, and use the work in the form of products and services including slogans, images, logos, and photos which are Our property (Intellectual Property rights), whether for Your benefit or the interests of any party.

  1. Applicable Law: All provisions of this Privacy Policy are subject to and interpreted in accordance with applicable laws in the Republic of Indonesia.
  2. Dispute Resolution: You hereby agree that any dispute between You and Us will be resolved amicably. In the event that an amicable settlement cannot be reached, then You agree to settle the dispute at the South Jakarta District Court.
